Letter of Exemption

A letter of exemption is a document from the certification body stating that the products are not subject to mandatory certification.

There are some kinds of letters of exemption depending on the body that issues it:

  • Customs letter of exemption (letter of exemption of All-Russia Scientific Research Institute for Certification)
  • Trade letter of exemption
  • Rosstandart (Body for confirmation of certification) letter of exemption
  • Ministry of Industry and Trade letter of exemption
  • Fire safety letter of exemption (letter of exemption for the fire safety certificate)

RosStandart letter of exemption (earlier called GosStandart letter of exemption) certifies that the products are not established by RosStandart as subject to mandatory certification in Regulation of December 1, 2009 № 982 » On the Nomenclature of products subject to mandatory certification», as well as that the products do not fall within the scope of application of Technical regulations.

Ministry of Industry and Trade letter of exemption is issued on the basis of Letter to the Federal Customs Service № 10951/10 of 05.10.2010 in accordance with Decision of the Customs Union Commission № 319 of 18.06.2010 and RF Government Regulation № 982 of 01.12.2009.

All-Russia Scientific Research Institute for Certification and Ministry of Industry and Trade letters of exemption are also issued, when needed, with respect to conformity to requirements to Technical Regulations in force.

You can obtain the letter of exemption at any certification body (except for All-Russia Scientific Research Institute for Certification letter of exemption which is issued by All-Russia Scientific Research Institute for Certification).

The letter of exemption can be valid for one year, but more often letters of indefinite duration are issued the validity of which is not specified and which are valid until introduction of changes into the Lists of products subject to mandatory certification.

The list of documents necessary for obtaining the letter of exemption for customs and trade

For customs:

  • Contract with specifications, Invoice;
  • Description of products (technical specification, scope of application, their appearance);
  • Commodity Nomenclature for Foreign Economic Activities code of the products;
  • application with the signature and stamp of the applying firm including the applying firm′s requisites;
  • the applying firm′s letter of attorney for a natural person with the right to accept the letter.

For trade:

  • Description of products (technical specification, scope of application, their appearance);
  • All-Russian Classifier of Products code of the products;
  • application with the signature and stamp of the applying firm including the applying firm′s requisites;
  • the applying firm′s letter of attorney for a natural person with the right to accept the letter.
